Run by
SEND Education Advice Team at Skylarks
Local Authorities have until 15th February 2025 to issue a final plan naming a school for a young person transferring to secondary school in 2025.
This session will be a workshop session for families of children with an EHCP who have requested a particular placement for secondary school in September 2025 and have not been offered their preferred placement.
Please book this course if you are in this situation currently. We will send you an email around the 15th Feb to check if you still need to attend and asking for some details about the situation.
If after you have booked you are offered your choice of setting then please remember to cancel the booking.
This session will take place at the Crossway Centre in Twickenham.
Deadline for Naming a setting for year 7 for Children with an EHCP
Initial steps that families could take as soon as they receive the final plan or a notification of intention to amend the EHCP are to:
a) Contact the SENDCO of the school that you have been offered and ask to meet with them to see what they are able to offer.
b) Contact your caseworker in the Local Authority and ask them to share the consultation responses of schools that they have named and any schools that you would prefer were named.
c) Ask for a meeting with your caseworker and one of the managers in the local authority to discuss the decision.
Note that the local authority has to name a school you have asked for unless they can show that Section 39 of the Children and Families Act, (sub section 4) applies which states:
(a) the school or other institution requested is unsuitable for the age, ability, aptitude or special educational needs of the child or young person concerned, or
(b) the attendance of the child or young person at the requested school or other institution would be incompatible with—
(i) the provision of efficient education for others, or
(ii) the efficient use of resources.
